Terms and Conditions in brief
The Terms and Conditions form a binding contract between NCCF and every account holder. This summary covers the main obligations; the official text prevails.
You accept the Terms and Conditions when you click “I agree to Terms and Conditions” during account opening. They form a binding contract with NCCF. Where they conflict with other Registry rules, the Registry rules prevail.
Key points
- Services. NCCF is the exclusive provider of Registry IT services: account opening, project and methodology listing, MCU issuance, transfer, retirement, cancellation and tracking, and fee payment.
- Listing and issuance. NCCF lists projects and issues MCUs only when the required information is submitted, the rules are met, a VVB has validated or verified, NCCF has reviewed, and fees are paid. It may refuse at its sole discretion.
- Parallel projects. A project registered in more than one programme may request issuance from only one. Issuance from both leads to cancellation of MCUs and compensation.
- Transfers. MCUs can be transferred only between IPP and TO accounts. NCCF may reverse erroneous or fraudulent transfers.
- Retirement and cancellation are permanent and irreversible.
- Buffer Pool. Account holders follow the buffer rules and top up any shortfall.
- Fees. Paid through the platform; due within 30 days; late payment interest of 2% per day for 30 days; then suspension. See Fees and when they are paid.
- Data. You keep ownership of your information but give NCCF a royalty-free licence to use and display it. NCCF owns derivative works and Registry content. Using Registry data or NCCF marks needs prior written permission.
- Confidentiality. Both sides keep confidential information confidential, unless the law requires disclosure.
- Liability. Services are provided “as is”. You are responsible for your own systems and credentials.
- Force majeure does not excuse payment obligations.
- Indemnity. You indemnify NCCF against claims arising from breaches, negligence, fraud or inaccurate information.
- Disputes. Indian law applies, with courts in Delhi. Disputes go first to senior management, then to arbitration by a sole arbitrator seated in Delhi, in English.
- Revision. The Terms are reviewed every two years or when NCCF deems appropriate. You are responsible for following the current version.
